Does My Landlord Have to Mitigate Damages in Washington?

If you're renting in Washington State, your landlord is required by law to try and find a new tenant to replace you if you move out early.


Washington State law requires a landlord to mitigate damages. This means that they must make a good-faith effort to find a new tenant to fill the unit you're vacating. They must advertise, show, and attempt to fill the unit just like they would with any other apartment they manage.

This means that, as long as you are able to provide your landlord with a new tenant who meets the same qualifications that you met, you should not be held responsible for any future rent payments. Your landlord cannot unreasonably refuse the tenant you offer as your replacement.
