Holdover Tenant

A holdover tenant is someone who has stayed in their rental unit past the end date on their lease. Holdover cases typically result in one of two outcomes:

  1. The tenant continues to pay rent, and the landlord accepts the money. A new month-to-month tenancy is created.
  2. The landlord begins eviction proceedings, typically by delivering a notice to cure.

Some states have specific legal guidelines for how to evict a holdover tenant, while others allow landlords to follow the same process as any other tenant eviction.
