Subletting Laws in Hawaii

You can sublet without asking your landlord for the green light as long as your Hawaii lease doesn't say otherwise.


Chapter 521 of the Hawaii Revised Statutes gives residents of the aloha state permission to sublet without landlord approval unless the lease says otherwise. This means that if your signed, written rental agreement has a term in it that says either you can't sublet or you must obtain landlord approval beforehand then you must follow these instructions. Otherwise, you're golden.

Keep in mind that this law doesn't apply to you if you live in government-subsidized housing.
