Subletting Laws in Idaho

There isn't any legal guidance about subletting in Idaho, so you should assume that you need your landlord's approval.


Idaho statutes do not reference subletting. However, according to the landlord and tenant manual published by the Idaho Office of the Attorney General, a tenant has the right to sublet unless the rental agreement specifically prohibits this. An original tenant who sublets remains responsible to the landlord unless otherwise consented to by the landlord.
