Requesting a Repair in Texas

The first step towards getting your landlord in Texas to fix something is to make a request - also known as a demand letter.


You need to send your landlord a request for them to fix the problem right away. The law does not specify how you should give notice, but The Texas Supreme Court has held that the notice “must be in writing only if the tenant's lease is in writing and requires written notice.” That being said, it’s always best to put the notice in writing and have it delivered via certified mail so you can prove, if necessary, that your landlord knew about the problem.

In order to take any more actions you have to either send them one letter via certified mail or two hand-delivered letters, waiting a reasonable amount of time between each notice.

Pursuant to Texas Property Code 92.056, I request that these problems be repaired or remedied as soon as possible. Please provide a written explanation to me if there will be any delay in fixing these problems. If you or your agent require access to my home in order to inspect and fix these problems, please provide me advanced notice of your proposed entry. Thanks for your prompt attention.
