Subletting Laws in Colorado

Colorado has not passed any legislation on the topic of sublets, but your landlord does have to accept a qualified subtenant.


Colorado has not passed any legislation pertaining to subleases for landlords and tenants. Most lease agreements here do not strictly prohibit the practice, so you can likely go ahead with your sublet as long as you get landlord approval.

In Colorado, your lease might explicitly allow, restrict or completely prohibit your right to sublet. In any of these cases, you also must get written landlord approval for the arrangement.

As with sublets everywhere, if the subtenant doesn't pay rent then a landlord may sue the original tenant, the subtenant, or both.

Under Colorado case law and page three of the Colorado Landlord Tenant Handbook, unless the lease prohibits subleasing, a landlord may not unreasonably withhold permission to sublet.
