Can a Landlord Ignore or Refuse my Request to Sublet in Delaware?


A landlord cannot unreasonably refuse or withhold your request to sublet Delaware.

Reasonable Refusal

A refusal is considered reasonable if the landlord reviews the subtenant's information and finds that the proposed subtenant does not meet certain related requirements. For example, if they are unemployed or have a poor credit history.

Unreasonable Refusal

Your landlord can only reasonably refuse your sublet request. If they refuse for any reason that could be discriminatory, that is considered unreasonable. This means that your landlord cannot refuse a proposed subtenant based on their race, creed, religion, marital status, color, sex, national origin, disability, age or occupation or because the subtenant or prospective subtenant has a child or children in the family.
