Can a Landlord Ignore or Refuse my Request to Sublet in New Hampshire?


New Hampshire's laws do very little to address subletting. Most state laws say that if a landlord rejects your proposed subtenant, they must have good reason. New Hampshire doesn't address this specifically in their state laws.

Reasonable Refusal

There are no New Hampshire statutes or guidance for what kind of refusal is reasonable, so you can follow the general rule of thumb: an applicant can only be reasonably refused if it can be proven that they would put the landlord's business at risk. If there is no evidence that they would have the ability to pay the rent reliably as a subtenant then there are grounds for reasonable refusal.

Unreasonable Refusal

New Hampshire does have a Fair Housing Act. The law states that anyone seeking housing cannot be discriminated against for age, sex, race, creed, color, marital status, familial status, physical or mental disability or national origin. If your landlord rejects a subtenant based on any of these criteria, it's likely that a court would deem it unreasonable refusal and against the Act.
