Does My Landlord Have to Mitigate Damages in Oregon?

As a renter in Oregon, your landlord is required by law to try and find a new tenant to replace you if you move out early.


Oregon signed on to the Uniform Residential Landlord Tenant Act, which states that a request to assign a lease can only be denied if the landlord has a “commercially reasonable objection” to the assignment.

This means that, as long as you are able to provide your landlord with a new tenant who meets the same qualifications that you met, you should not be held responsible for any future rent payments. Your landlord cannot unreasonably refuse the tenant you offer as your replacement.
